According to Law on Fight Against Terrorism (with number 3713) sharing articles, pictures, phrases, wearing specific clothes or colours and or carrying clothes or colours could be considered for propagate of terror organisations. So called “sharing terrorist propaganda”. Those who share this kind of information could be convicted on terrorism charges. Since Turkey regards PKK, DEAS, YPG many other organisations as terror organisations, it is possible to across the line between free speech and “act of terrorism”.
Article 7. of Law on Fight Against Terrorism posting these kinds of content on social media like Facebook, Instagram, Twitter (newly x platform), Tiktok can be considered as propaganda of terror organisations and could be sentenced up to five years imprisonment. İt is also possible to be considered as terrorist, if you have a membership of such an organisation. Any person, who is member of an terror organisation could be charged by Article 314 of Turkish Penal Code (with number 5237). According to that:
“(1) A person who establishes or manages an armed organization for the purpose of committing the crimes in the fourth and fifth sections of this section shall be sentenced to imprisonment from ten to fifteen years.
(2) A person who is a member of an organization defined in the first paragraph shall be sentenced to imprisonment from five to ten years.
(3) A person who is not a member of the organization but commits a crime on behalf of the organization shall also be sentenced to imprisonment from five to ten years. The sentence may be reduced by up to half depending on the nature of the crime committed.
(4) Other provisions regarding the crime of establishing an organization for the purpose of committing a crime shall apply to this crime in the same manner.” (translated via Google Translate).
